TERMS AND CONDITIONS

1. GENERAL TERMS AND CONDITIONS OF SALE apply to all purchases made from Menken Works of Art B.V.

1.1 To purchase our products, you must contact us via the contact form on our website.

2. CONTACT AND ORDERS

2.1 To purchase an artwork, you must submit a request through the contact form on our website. Please clearly state the name of the artwork and any specific requests.

2.2 Upon receiving your request, we will contact you within 2 business days to confirm availability and discuss further purchase procedures.

3. PRICES

3.1 The price of the goods, shall be the price agreed between customer and seller as set out in the invoice.

3.2 All prices are in EURO, including value added tax (VAT), unless otherwise mentioned.

4. PAYMENT

4.1 Payment of the full amount must be made within 30 days after the date of the invoice, unless otherwise agreed in writing by the parties.

4.2 If the customer fails to make payment in full within 30 days after the date of invoice, seller will have the right to exercise legal rights and remedies.

4.3 In some cases, payment in terms can be discussed. The deposit in this case is at least 20%. Payments in terms are non-refundable, and for items paid in terms, the sale is final.

4.4 In case of payments through PayPal, costumer has to add 4% to cover fees that PayPal charges over payments.

5. STATEMENTS BY SELLER

5.1 Any statement by the seller as to the authorship, origin, date, age, attribution, genuineness, source, provenance or condition is a statement of opinion only based on the generally accepted knowledge and literature at or about the time of sale, and no warranty is given by the seller in respect thereof.

5.2 Goods are sold with all faults and imperfections as stated in the descriptions and the customer should satisfy themselves by inspection as to their condition and otherwise rely on their own judgment.

6. DELIVERY AND SHIPPING

6.1 Shipping of artworks will be arranged after full payment of the order.

6.2 Shipping costs, import and export duties and insurance are for the account of the customer, unless otherwise agreed upon in writing.

6.3 We aim to ship artworks within 14 days after receiving full payment, unless otherwise agreed.

6.4 All artworks are carefully packaged to prevent damage during transit.

7. CANCELLATION AND RETURNS

7.1 Cancellation of the order is possible within 14 days after placing the request, provided the artwork has not yet been shipped.

7.2 Returns are only accepted if the artwork arrived damaged and this is reported within [number] days after receipt.

8. LIABILITY

We are not liable for delays or damage caused by the shipping service. Upon receipt, you must check the condition of the package and report any damage directly to the carrier.

9. INTELLECTUAL PROPERTY

9.1 All content published on our website, including artworks, images, and texts, is owned by us or our licensors and is protected by intellectual property laws.

9.2 You may not reproduce, distribute, or otherwise use any content without our express written permission.

10. PRIVACY POLICY

Your personal information is treated confidentially and not shared with third parties, except as necessary for handling the order and delivery.

11. AMENDMENTS TO THE TERMS

We reserve the right to amend these terms and conditions at any time. The amended terms apply as soon as they are published on our website.
